RECITALS
A. Developer subjected certain lands owned by it, 10- in St. Johns County, Florida, to
that terrain Declaration of Covenants and Restrictions recorded in Official Records Book655, page 1821
of the public records of St. Johns County, Florida, as amended in First Amendment to Declaration of
Covenants and Restrictions of Julington Creek Property Owners'Association, Inc. rbcorded in mcial
Records Book 666, page 2039; Second Amendment to Declaration of Covenants and Resaiaions of
Julington Creek Property Owners' Association, Inc., recorded in Mcial Rscords Book 676, page 98;
Third Amendment to Declaration of Covenants Pnd Restrictions of Julington Creek Propmy Owners'
Association, Inc., recorded in Official Records Book 801, page 816; Founh Amendment to DecIaration
of Covenants and Restrictions of Julington Creek Property Owners' Association, Inc., recorded inOfficial
Records Book 929, page 536, and First Amendment to Founh Amendment to Declaration of Covenants
and Restrictions of Julington Creek Property Owners' Association, Lnc. recorded in Official Records Book
990, page 1500, and Partial Termination of Declaration of Covenants and Restrictions of Julington Creek
Plantation Owners Association, Lnc. recorded contemporaneously herewith; all recorded in the public
records of St. Johns County, Florida, collectively referred to as 'Declaration.'
B. In connection with the development of the land subject to the Declaration, plats were
recorded in the public records of St. Johns County, Florida, but no roads, utilities or related
infrastructure were consuucted for a significant portion of the land subjected in the Declaration.
C. Certain Lands more fully described as:

17, pages 1 -21 of the public records of St. Johns
County, Florida, (jointly hereianffer refmed to as "The
Greens")
have been or will be developed as single family dwellings, my of which have been conveyed to third
parties .
D. The property described in Exhibit Bed hereto (the "Additional Property") was
withdrawn from the Declaration by the Partial Turnination refened toabove. Developer may, &om time
to time add any of the Additional Property (ashereinafter defined) to tbe Declaration in accordance with
the tams and conditions of this Amendment.
E. Further, the Declaration provides for r stated initial nte of assessments payable to
Julington Creek Plantation Property Owners' Association, Inc. fonnaly known as Julington Crak
Property Owners' Association, Inc. (the "Association") as well ulimitations on the increases in said rate
from year to year.
F. At the time the Declaration was recorded, Developer did not contemplate significant
"Common Property" thereunder, whether active or passive, the cost and expense of which would be
borne solely by all or part of the members of the Association by way of Assessments levied pursuant to
the Declaration.
G. Developer now intends, but in no way guarantees, that more significant active and passive
Common Property and facilities may be developed, which will benefit all or some of the Ropexty or
portions of the Property subject to this Amended Declaration.
H. Because of the foregoing, Developer now desires to provide a mec
